- Optiworld makes no promises as to the condition, service and suitability of the resort during the stay of each winner at the resort.
- Optiworld is not responsible for any acts of persons, businesses or God that may impact the well being and stay of the winner at the resort.
- Winners are personally liable for any orders placed or charges incurred at the resort during their stay.
- Optiworld reserves the right to disqualify a winner in the event that (i) we are unable to verify or authenticate any information they have been provided to us; and (ii) we believe that your actions may cause financial loss or legal liability for you, to use or our associates.
- You agree that Optiworld will not be liable to you or to any third party for such disqualification.
- By participating in the drawing, each patient agrees to be fully and unconditionally bound by the rules of Optiworld.
If any portion of these rules, terms and conditions become void, it will not affect the validity and enforceability of the remaining provisions. The void part will be replaced by provision that are valid and have legal effect.
LIMITATION OF LIABILITY
Use of the vacation resort is at winner’s own risk. Optiworld Vision Center, LLC, and any of its affiliates, officers, directors, agents or any other party involved in the operation of the Loyalty Vacation Prize award shall not be liable for any direct, indirect, special, consequential, mental, emotional, biological, chemical, mechanical, natural or other damages that result from the use of the Loyalty Vacation Prize.
INDEMNITY
Users of the Loyalty Vacation Prize award agree to defend, indemnify and hold Optiworld Vision Center, LLC, and any of its affiliates, officers, directors, agents or any other party involved in the operation of the Loyalty Vacation Prize harmless from any and all liabilities, costs, and expenses, including reasonable attorney’s fees, related to any violation of Optiworld terms, the rules, regulations and terms of the vacation resort by the winner and the affiliated authorized users, or the violation of any law or rights of a third party.
TERMINATION
Winner or Optiworld may suspend or terminate the use of the Loyalty Vacation stay prize at any time before check-in time, for any reason or for no reason.
